Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and Mahajan & Pandey Software Solutions ("we," "us," "our") covering your use of the Vibo mobile application ("Vibo" or "the App"). Please read carefully. By installing, accessing, or using Vibo, you agree to these Terms and to our Privacy Policy.

1. Eligibility

You must be at least 13 years old to use Vibo. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Your Account

You are responsible for maintaining the confidentiality of your sign-in credentials and for all activity under your account. Sign in to Vibo using Google Sign-In or Sign in with Apple; we do not manage your password directly. Notify us immediately if you suspect unauthorized access.

3. Subscriptions and Purchases

3.1 Products

Vibo offers the following in-app purchases to unlock the "Pro" tier:

• Monthly subscription - auto-renewing, billed monthly.
• Yearly subscription - auto-renewing, billed annually. May include an introductory free trial; your payment method is charged at the end of the trial unless you cancel.
• Lifetime - a one-time, non-consumable purchase that unlocks Pro for as long as Vibo remains available.

Current prices are shown in the App before you confirm purchase. Prices may vary by region and may change over time; any change will not apply to an existing active subscription until its next renewal.

3.2 Billing, renewal, and cancellation

• Auto-renewing subscriptions renew for the same period at the then-current price unless cancelled at least 24 hours before the end of the current billing period.
• Payment is charged to your Apple ID or Google Play account at confirmation of purchase and at each renewal.
• Manage or cancel auto-renewal any time: on iOS in Settings → [your name] → Subscriptions; on Android in the Google Play Store → Menu → Subscriptions.
• Uninstalling the App does not cancel a subscription.

3.3 Free trials and introductory offers

If a free trial is offered, you must cancel before the trial ends to avoid being charged. New subscribers only, as determined by the App Store or Google Play. One trial per subscription group per Apple ID / Google account.

3.4 Refunds

All purchases are processed by Apple or Google and are governed by their refund policies. Contact Apple Support or Google Play Support for refund requests. We do not process refunds directly.

3.5 Founder / Launch Lifetime

If Vibo offers a limited "founder" lifetime tier, availability, pricing, seat count, and cut-off date are shown in the App at the time of purchase. Purchases made after the seat cap is reached or the offer window closes are still fulfilled (you receive lifetime Pro access), but you may not receive the founder seat number or any founder-specific badge.

4. Acceptable Use

You agree not to:

• Use the App in any unlawful manner, or for any unlawful purpose.
• Attempt to reverse engineer, decompile, or extract source code from the App, except to the extent expressly permitted by applicable law.
• Interfere with, disrupt, or probe the App or our servers, including through automated scraping, denial-of-service, or bypassing rate limits.
• Submit unlawful, abusive, threatening, defamatory, or infringing content through AI chat, vision boards, journals, or any other feature.
• Share your account with others, resell access to Vibo, or impersonate another person.
• Use Vibo's AI features to generate content that sexualizes minors, incites violence, or violates the acceptable-use policies of our AI providers.

5. Your Content

You retain ownership of the content you create in Vibo (your intentions, vision boards, journal entries, uploaded images, and chat prompts - collectively, "Your Content"). You grant us a limited, worldwide, royalty-free license to host, store, transmit, and display Your Content solely to operate the App for you. We do not use Your Content for advertising, and we do not sell it.

You represent that you have all necessary rights to any content you upload, and that it does not infringe any third party's rights.

6. AI Features and Disclaimers

AI responses are generated by third-party language models (Google Gemini, OpenAI). Do not rely on them for any decision that could affect your health, safety, legal rights, or finances.

7. Intellectual Property

The App, including its design, code, text, graphics, audio, and trademarks, is owned by Mahajan & Pandey Software Solutions or its licensors and is protected by copyright, trademark, and other laws. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the App for your own non-commercial purposes.

8. Third-Party Services

Vibo uses third-party services (listed in our Privacy Policy). We are not responsible for the availability, accuracy, or content of those services, and your use of them is governed by their own terms.

9. Termination

You may stop using the App and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the App. On termination, sections that by their nature should survive (ownership, disclaimers, liability limits, governing law) will continue to apply.

10. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR MEET YOUR EXPECTATIONS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAHAJAN & PANDEY SOFTWARE SOLUTIONS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, OR DATA, ARISING FROM OR RELATED TO YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE APP IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) US $50.

12. Indemnification

You agree to indemnify and hold harmless Mahajan & Pandey Software Solutions and its officers, employees, and agents from any claim, loss, or expense (including reasonable attorneys' fees) arising from your violation of these Terms, your misuse of the App, or your infringement of another party's rights.

13. Governing Law

These Terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to its conflict-of-laws principles. You and we agree to the exclusive jurisdiction of the state and federal courts located in Suffolk County, Massachusetts for any dispute not subject to arbitration, subject to any mandatory consumer-protection laws of your place of residence.

14. Apple-Specific Terms

If you obtained Vibo through the Apple App Store, you acknowledge that these Terms are between you and Mahajan & Pandey Software Solutions, not Apple. Apple is not responsible for the App or its content. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

15. Changes to These Terms

We may update these Terms from time to time. We will post the updated version here with a new "Last updated" date. If changes are material, we will also notify you in the App. Continued use of the App after an update constitutes acceptance of the updated Terms.
